Terms of Service

1. Purpose

These Terms of Service (hereinafter the "Terms") govern the conditions of access to and use of the PrestaSAV service, accessible at https://www.prestasav.com/, published by SASU AIKINI.

By creating an account or using the Service, the user acknowledges having read and accepted these Terms in their entirety.

2. Service Description

PrestaSAV is a Software-as-a-Service (SaaS) application for AI-powered customer support management for PrestaShop e-commerce stores. The Service provides the following features:

• AI classification — Automatic categorisation of customer emails into 13 categories, with urgency scoring from 1 to 5 and sentiment analysis.
• PrestaShop enrichment — Real-time retrieval of customer, order, stock and carrier data from the connected PrestaShop store via the Webservices API.
• AI response drafts — Generation of intelligent reply suggestions with a choice of tone (empathetic, formal, concise).
• Unified dashboard — Centralised inbox sorted by urgency, advanced filters, SLA tracking and analytics.
• Notifications — Real-time browser alerts for urgent tickets and customer replies.

Important: The AI never sends automatic replies to customers. All AI-generated responses require human validation before sending. The merchant retains full control over all communication.

3. Access Conditions

Use of PrestaSAV requires the creation of a user account. The user is solely responsible for maintaining the confidentiality of their login credentials and for all activities conducted under their account.

The user undertakes to provide accurate and up-to-date information during registration and to notify PrestaSAV immediately of any unauthorised use of their account.

PrestaSAV is compatible with PrestaShop 1.6, 1.7, 8.x and 9.x. Connection to the PrestaShop store is established via the Webservices API, which must be enabled and configured on the store.

4. Free Trial

PrestaSAV offers a 14-day free trial with access to all features. No credit card is required to start the trial.

At the end of the trial period, access to the Service is suspended unless the user subscribes to a paid plan. User data is retained for 30 days following the end of the trial, after which it may be permanently deleted.

5. Pricing and Payment

The Service is offered at a price of €49 per month, excluding VAT. The applicable VAT rate depends on the user's country of residence, in accordance with the regulations in force.

Billing is monthly, and payments are processed securely via Stripe. The user authorises recurring charges to the payment method provided upon subscription.

In the event of a failed payment, PrestaSAV reserves the right to suspend access to the Service until payment is resolved.

6. Duration and Termination

The subscription is monthly with no minimum commitment. The user may cancel their subscription at any time from their account settings.

Cancellation takes effect at the end of the current billing period. The user retains access to the Service until the end of the paid period. No prorated refunds are issued for the remaining portion of the current month.

PrestaSAV reserves the right to terminate a user's account immediately in the event of a breach of these Terms, without prejudice to any damages that may be claimed.

7. Service Availability

PrestaSAV targets an uptime of 99.5%, excluding scheduled maintenance periods.

Planned maintenance operations are announced at least 48 hours in advance via email or in-app notification. PrestaSAV shall not be held liable for service interruptions resulting from force majeure, third-party actions, or circumstances beyond its reasonable control.

8. Intellectual Property

The Service, including its source code, design, algorithms, documentation and all associated content, is the exclusive property of SASU AIKINI and is protected by applicable intellectual property laws.

The subscription grants the user a non-exclusive, non-transferable, revocable licence to use the Service for its intended purpose and for the duration of the subscription only.

The user may not reproduce, modify, decompile, reverse-engineer, distribute or create derivative works of the Service, in whole or in part.

9. Personal Data

PrestaSAV processes personal data in accordance with its Privacy Policy and in compliance with Regulation (EU) 2016/679 (GDPR).

The user is invited to read the Privacy Policy for full details on how their personal data is collected, processed, stored and protected.

10. Limitation of Liability

The Service is provided "as is" without warranty of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose or non-infringement.

In no event shall PrestaSAV or SASU AIKINI be liable for:

• Any indirect, incidental, special, consequential or punitive damages;
• Loss of revenue, profits, data, business opportunities or goodwill;
• Service interruptions caused by third parties, force majeure, or the user's own actions.

In all cases, the total aggregate liability of PrestaSAV shall not exceed the amounts actually paid by the user during the 12 months preceding the event giving rise to the claim.

11. Changes to Terms

PrestaSAV reserves the right to modify these Terms at any time. Users will be notified of any material changes at least 30 days in advance by email or in-app notification.

Continued use of the Service after the effective date of the changes constitutes acceptance of the updated Terms. If the user does not agree with the changes, they may terminate their subscription before the new Terms take effect.

12. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of France.

In the event of a dispute arising from or in connection with these Terms, the parties agree to first seek an amicable resolution through mediation. If mediation fails, the dispute shall be submitted to the exclusive jurisdiction of the competent courts.
